Since my 2010 appointment to the State Bar Trusts and Estates Section Executive Committee, one responsibility for me has been to chair the Educating Seniors Project. This month, I was a featured speaker on the Bay Area KALW radio program “Your Legal Rights” to describe the Project. Here is the link to listen to the program: “Educating Seniors Project.”
The Educating Seniors Project informs seniors, their families, and the community about laws and resources for protection against elder financial abuse. Volunteer Speaker Attorneys give our presentation “Preserve your Independence – Protect your Assets” at senior centers, service clubs and other organizations throughout California. Our informative website has additional helpful resources, including links to pamphlets published by the State Bar.
Community awareness and education is a proven strategy to prevent Elder Financial Abuse. Learn the “red flag” warning signs to spot a scam. Know who to call if a friend or neighbor may be at risk of theft by a care provider or family member. Every county has an Adult Protective Services agency which may be a good first step to get help.
A qualified attorney can answer questions, and prepare documents such as a Durable Power of Attorney, Trust or Will to designate someone you trust to act as your agent. The aging process inevitably leads to memory decline, and sometimes impaired judgment. Planning ahead is critical to have in place a trustworthy team for protection against possible elder abuse.
